Admitted as a solicitor in 2003 and called to the Bar in 2010, Gabriella practises in all areas of intellectual property (patents, trade marks, copyright and plant breeders’ rights), media, competition, consumer and contract law, intentional torts, defamation, breaches of confidence and privacy law, the latter including data breaches and the new statutory tort of serious invasion of privacy, and in the legal issues raised by artificial intelligence. She also practises in health practitioner regulation, representing medical specialists in regulatory investigations, professional discipline and hospital credentialing disputes.
Gabriella appears regularly in the High Court of Australia, in appeals, special leave and removal applications, in some of the most notable intellectual property, defamation and implied freedom of political communication cases of the past 16 years, most recently for the successful respondent in the Court’s 2026 trade mark appeal on honest concurrent use, Zip Co Ltd v Firstmac Ltd.
Gabriella advises on the legal questions raised by artificial intelligence: copyright and training data, the patentability of computer implemented inventions, privacy and automated decision making, and liability for generated content. Her engagement with technology outpacing the law dates to the Copyright Tribunal proceedings on royalty rates for digital downloads at the advent of online music distribution. She speaks on AI, law and policy, understands the science behind large language models and writes software with them.
Gabriella has a deep interest in medicine, biology and physiology, and expertise in human and animal health, where she appears in patent, regulatory and misleading conduct cases. She has more than 20 years’ experience in patent litigation and has served as Counsel Assisting the Royal Commission into Defence and Veterans’ Suicide and the Queensland Commission of Inquiry into DNA Project 13.
Gabriella often appears in oppositions and removals before IP Australia and accepts direct briefs in that jurisdiction.
Gabriella is recognised in Chambers Asia and Pacific, Doyle’s Guide (NSW and Australia), Australia’s Best Lawyers (Intellectual Property; Defamation & Media), The Legal 500 Asia & Pacific (TMT & IP) and the World Trademark Review.
Gabriella is fluent in Italian: she acts in cases involving Italian entities, drafting affidavits, translating commercial documents and conferring with clients and witnesses, and has particular knowledge of Italian geographical indications. She is one of three cited translators of Puppi and Baccaglini (eds), Tiziano Vanitas: Il poeta dell’immagine e l’ombra della bellezza (Silvana Editoriale, 2016). She also reads Classical Greek, with a particular interest in lyric poetry.
Gabriella holds a Bachelor of Laws and a Bachelor of Arts (Hons) degree from the University of New South Wales.
